Accuracy Firearms Suit Against Weapons Ban Dismissed

The lawsuit filed by Accuracy Firearms of Effingham and a number of other plaintiffs, challenging the Protect Illinois Communities Act, has been dismissed.

Douglas Jarman, the chief judge of the 4th Judicial Circuit, had taken the matter under advisement in May. Since then, the Illinois Supreme Court ruled 4-3 that the state's weapons ban is constitutional. 

In his ruling, Jarman dismissed the plaintiffs' contention that the three readings rule was not followed when the weapons ban was adopted. He also dismissed the contention that the plaintiffs were denied equal protection. Jarman also ruled against granting a permanent injunction against enforcement of the weapons ban since he had dismissed the other two issues. 

A Temporary Restraining Order was also dismissed by Jarman.

While things continue to move in favor of the weapons ban at the state level, Greenville attorney Thomas DeVore said he plans to appeal Jarman's ruling. 

The matter also is expected to be an issue at the Federal level.
