It will likely be two more weeks before we know where St. Rep. Darren Bailey's lawsuit against Gov. J.B. Pritzker will go to court.
During a hearing Tuesday afternoon, Magistrate Judge Gilbert Sison agreed to Bailey's request to expedite the matter. It could have been June 12 before the matter proceeded before the magistrate. Instead, the deadline will be June 2. Pritzker will have until June 5 to respond and, then, Bailey will have until June 10 to answer any response by Pritzker.
The only thing to be decided at this point is where the case will be heard, Federal court or Circuit court.
While the lawsuit is Bailey vs. Pritzker, the US Justice Department has intervened in the matter, supporting the lawsuit filed by Bailey and challenging some of Pritzker's actions in response to the pandemic. Southern District US Attorney Steven Weinhoeft was present for the Justice Department at Tuesday's hearing.
